INTEL AND APPLE TO USE TSMC 3NM TECH

Apple and Intel have secured orders and projects with TSMC’s 3-nanometer (nm) chips. TSMC expects the 3nm technology to increase performance by 10 to 15% while reducing power consumption by 25 to 30% compared to its current 5nm technology. Although Intel and TSMC are considered competitors, Intel has confirmed that it will outsource the manufacturing of its core products to TSMC and plans to invest USD 20 billion in TSMC’s Arizona factories.  Apple’s self-designed M1 chips are based on TSMC’s 5nm tech. The 3nm tech will likely benefit Apple’s future products with its self-designed chips.

TAIWAN CHIP AND TECH EXPORT INCREASES

The Ministry of Economic Affairs (MOEA) reported on Monday the value of export orders with Taiwan businesses in May totaled NTD 52.3 billion - a 34.5 percent year-over-year increase and a 15 month consecutive growth. From January to May this year, Taiwan’s export orders totaled USD 256 billion - an annual increase of 41 percent. However, officials see a slightly slowing increase in demand for June, predicting orders will increase by 28.1 percent to 31.7 percent in June. Earlier this month, Japan and TSMC signed off on a USD 338 million semiconductor project to develop cutting edge chip technology. Taiwan’s expansion in the chip industry has grown substantially to meet global demands for semiconductors. Taiwan factories have been running at full capacity since 2020, in part due to the lower impact of COVID in Taiwan in 2020.

TAIWAN STAR TELECOM EXPANDS 5G WITH NOKIA

  Taiwan Star Telecom (TST) announced its partnership with Nokia to extend its 5G network in Taiwan. Nokia will provide equipment from its latest AirScale portfolio for TST’s 5G standalone network. TST aims to increase its customer base by 20% by the end of the year and is expected to enhance its 5G network coverage and performance for its customers.  With 800,000 5G subscribers, TST aims to increase its customer base by 20% by the end of the year. Nokia’s 5G portfolio will help TST’s deployment and support its growing requirements. 

GOGORO-FOXCONN'S GLOBAL EXPANSION

  Gogoro and Foxconn announced yesterday its partnership aimed to globalize Gogoro’s battery swapping and smart vehicle technology. Gogoro’s founder and CEO, Horace Luke, commented on Gogoro-Foxconn's plans for expansions, “Our ability to rapidly scale our manufacturing to meet global demands is vital… Together, our companies will be on the forefront of rolling out smart mobility solutions in cities around the world.”   Foxconn has made several aggressive investments in the global EV ecosystem, including USD 15.5M in AutoCore automobile software, 36M in Gigasolar EV battery, partnership with Thailand’s state-run energy group PTT, and manufacturing deals with Byton and Fisker. At this rate, Foxconn is on its way to become one of the world’s leading manufacturers of EV’s. 

IPR WORKSHOP HELD BY TAIWAN, US AND JAPAN

  The Global Cooperation and Training Framework virtual workshop was held on June 17 through 18 in Taipei. Held jointly by Taiwan’s Ministry of Foreign Affairs (MOFA), Taiwan High Prosecutors Office (THPO), American Institute in Taiwan (AIT) and the Japan-Taiwan Exchange Association (JTEA), the workshop discussed IPR protection strategies on cross-border trade, trade-secret misappropriation, and online economic espionage. More than 100 experts and government officials from 20 countries took part in the virtual workshop to share their experiences in combating IP theft, infringement and fraud. During opening remarks, AIT Director Brent Christensen stated, “Promotion of the Four I’s [innovation, IPR protection, interaction and investment] will make each of our economies stronger as we develop the global economy for the modern era.”

使用P2P軟體下載電影-WIFI分享與檢察官之舉證

  謝孟芳實習律師、蔣昕佑律師 裁判字號: 智慧財產法院108年度刑智上易字第24號 裁判日期: 108年6月20日 相關法條: 著作權法第91條第1項、 第92條。  【判決要旨】 1.     目前一般民眾常用之WIFI無線分享器,係指在得接收訊號範圍內之網路裝置使用者即得透過該無線網路所分配之網路IP位置連線至網際網路, 縱有設定WIFI密碼,亦無法排除將密碼分享與他人使用或遭他人破解密碼後,使用被告家中之無線網路連結上揭網站下載本案影片之可能,是為確認使用本案IP上網下載本案電影之人確係被告,自須有確實證據證明。 2.     不能以被告係該IP位址申請承租者,即推論係其非法下載上揭影片。本件被告雖未能如上開案件之被告提出對其有利之證據以為證明, 但被告本受無罪推定原則之保護,享有默秘權,並無自證無罪之義務,或許其可能知悉是其親友中何人下載者,惟欲其供出該親友勢為強人所難,縱其須擔負管理該IP之責,然不得因此即要由其頂罪。再者,本件檢警並未搜索查扣被告個人使用之電腦設備或行動裝置,存有或曾有本案電影檔案,或其他足以證明被告確有使用本案IP下載本案電影之證據,自難僅憑被告為本案IP位址之租用人,即遽為不利於被告之認定。 3.     維持原審判決,被告無罪。   【判決摘錄】 一、        公訴要旨 被告陳保仁明知中文片名「寒戰2」(英文片名:ColdWar2,下稱本案電影)之電影係安樂影片有限公司專屬授權予告訴人華映娛樂股份有限公司之視聽著作,且 明知使用P2P(peer-to-peer,即點對點網路分享傳輸)軟體下載影音檔案,影音檔案下載儲存至電腦硬碟內之同時,亦會強制上傳分享至網際網路上供他人下載, 竟基於擅自以重製、公開傳輸等方法侵害他人著作財產權之犯意,未經告訴人之同意或授權, 於民國105年8月19日3時52分36秒起至同年月22日4時57分36秒止,在其位於新北市○○區○○○街00號住所內,使用電腦設備及其向中華電信股份有限公司(下稱中華電信)所申請之IP位址「118.167.182.68」(下稱本案IP)連接網際網路後,利用上開軟體自「速貢論壇」下載而重製上開電影檔案至其所有之電腦硬碟內,同時亦上傳分享該電影檔案至網際網路上供不特定人下載而公開傳輸。 因認被告涉犯著作權法第91條第1項擅自以重製之方式侵害他人之著作財產權及同法第92條擅自

視聽著作侵害酌定損害額-108年度民著訴字第45號判決評析

  108 年度民著訴字第 45 號判決評析 張晁綱律師  蔣昕佑律師 壹、基本事實 得利影視股份有限公司(下稱原告)為電影「人生按個讚」(下稱系爭著作)於臺灣地區之被專屬授權人。原告於106年2月26日發現被告未獲原告之同意或授權,於其位於桃園市之住處,利用電腦連結網際網路後,以Bit-Torrent傳輸網路傳輸軟體,非法下載重製系爭著作,並於非法下載同時接受其他安裝相同軟體之使用人之要求分享系爭著作,經臺灣桃園地方法院判決被告犯著作權法第91條第1項之非法重製罪,處拘役30日。原告另依著作權法第88條第1項、第3項規定,請求被告負損害賠償責任。 貳、本案主要爭議 為避免著作權受侵害之被害人因訴訟上之舉證困難,致其實體法上之損害賠償權利難以實現,著作權法第88條第3項因而定有由法院酌定損害賠償額之規範。惟法院於審酌損害賠償額時,實際考量之因素為何?如何決定具體損害賠償額?殊值探究。 參、法院判旨 一、適用前提:著作權法第 88 條第 3 項至多減輕被害人之舉證責任,被害人仍應於客觀上可能範圍提出相關證據 觀諸著作權法第88條第3項規定:「依前項規定,如被害人不易證明其實際損害額,得請求法院依侵害情節,在新臺幣一萬元以上一百萬元以下酌定賠償額。如損害行為屬故意且情節重大者,賠償額得增至新臺幣五百萬元。」可知,本條之適用以「被害人不易證明其實際損害額」為要件,從而本條立法意旨雖係為減輕被害人之舉證責任,惟 被害人仍應於客觀上可能範圍內提出證據,證明不易證明實際損害額之情形,並就損害賠償之金額提出可供依憑之計算基礎,以證明與損害數額相關的各種具體客觀情事 。 就本件而言,被告未經授權以BT軟體下載並公開傳輸系爭著作,使不特定使用者得以在各自選定的時間、地點,透過網際網路接收系爭著作之檔案,無從得知系爭影片因此遭下載的次數或數量,堪認無從依著作權法第88條第2項所定方式計算、證明原告之損害,足認合乎著作權法第88條第3項所定「被害人不易證明其實際損害額」要件。 二 、法院就賠償額之酌定範圍及因素 就損害賠償額之酌定範圍,著作權法第88條第3項業已明定,法院應依被害情節,於新台幣(下同)1萬元以上100萬元以下酌定賠償額,如損害行為屬故意且情節重大者,則以500萬元作為損害賠償額上限。是法院酌定賠償額,應以著作權法第88條第3項所定範圍為度,方屬適法、妥適。又智慧財產法院於
